On March 7, NEDO Silicon Valley hosted a webinar titled “The U.S. International Trade Commission: An Overview, Best Practices, and Recent Trends.” This event was part of the Bay Area CHIZAI (IP) Seminar Series.

The International Trade Commission (ITC) serves as a powerful forum in U.S. litigation that provides strong remedies and speedy decisions not available in any other forum. Rather than provide monetary damages, the ITC can issue exclusion orders prohibiting importation and sale of all infringing products into the United States. While the ITC is most frequently used in patent infringement disputes, companies often overlook its value for a wide range of IP and Lanham Act allegations.


This seminar offered a comprehensive two-part session on the ITC. In the initial segment, Brian Johnson, Eric Krause, and Jeannine Sano provided an in-depth presentation on the overview of the ITC, covering court procedures, remedies, and the interplay with inter partes review and district court litigation.


Following this, the second segment featured a panel discussion. We were privileged to host distinguished panelists, Douglas Peterson and Matthew Bathon, who, alongside Mr. Johnson, Mr. Krause, and Ms. Sano, shared insights from both in-house counsel and outside counsel perspectives. Together they explored the uses of the ITC and addressed actions for companies named as respondents.


Through this seminar, the attendees acquired invaluable insights into the nuances of ITC procedures, the collaborative roles of in-house and outside counsel throughout the process, and the critical factors for consideration. Since the ITC process moves very quickly, knowledge is crucial, and we appreciated the speakers sharing their insights with the audience.
